SiPhox understands the importance of protecting privacy of your information, and we take privacy practices seriously.

This policy describes the types of information we may collect from you or that you may provide when you: (i) download, install, register with, access, or use the Company mobile application (“App”), and (ii) visit the website (www.SiPhoxhealth.com) (collectively, with the App, our "Website") and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • On the Website.
  • From connected devices you may use, such as wearables that connect to our Website.
  • In email, text, and other electronic messages between you and this Website.
  • Through mobile and desktop applications you download from this Website, which provide dedicated non-browser-based interaction between you and this Website.

  • Us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries); or
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Website.

SiPhox reserves the right to amend this policy, and any new provisions will become effective for all protect health information it maintains (see Changes to Our Privacy Policy). Your continued use of this Website after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children Under the Age of 13

Our Website is not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Website. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Website or through any of its features, register on the Website, make any purchases through the Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. We collect several types of information from and about users of our Website, including information:

  • By which you may be personally identified, such as first name, last name, postal address, email address, telephone number, date of birth, financial information such as credit cards, height, weight, gender or any other identifier by which you may be contacted online or offline ("personal information"). In addition, we may ask you about your history of disease, symptoms, information about the medications you are taking, and other health and medical related information (“health information”). Health information is also personal information;
  • That is about you but individually does not identify you;
  • About your internet connection, the equipment you use to access our Website, and usage details; and/or
  • About your internet use, including your public social media activity, from third party providers that may track your activities.

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, and other tracking technologies.
  • From wearable devices that you may connect to the Services.
  • From third parties, for example, our business partners.

Our Heart Health Blueprint subscription is only intended for users who are 18 years of age or older, and is expressly not sold to members under 18.

Information You Provide to Us

The information we collect on or through our Website may include:

  • Information that you provide by filling in forms on our Website. This includes information provided at the time of registering to use our Website, subscribing to our service, posting material on the Community Forum, or requesting further services. We may also ask you for information when you report a problem with our Website.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Details of transactions you carry out through our Website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Website.
  • Information we collect by providing telehealth services, including health information you share during a session, your image, and other data provided between you and an independent, licensed healthcare professional (“Providers”).
  • As part of our Services, we provide access to telehealth care, including consultations with independent, licensed healthcare professionals (“Providers”) and related pharmacy services. These services involve the electronic transmission of personal health information (PHI), medical records, images, and other data between you and your Provider.
  • By using our telehealth services, you consent to the collection, use, and sharing of your health information for purposes including diagnosis, treatment, and care coordination, as described in this Privacy Policy. Your data may be transmitted via secure video, audio, messaging, or other digital means and may include information from remote monitoring or medical devices.
  • We implement technical and organizational safeguards to protect the privacy and security of your health information. However, as with any digital communication, there are inherent risks such as delays due to technological failures or data breaches despite these protections.
  • You may withdraw your consent to processing of the health information collected during telehealth services, at any time by contacting us. Please note that withdrawing consent may limit or prevent our ability to provide telehealth services and may require deletion of your telehealth-related health information.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Do Not Track Browser Setting. We do not currently respond to “do not track” signals from web browsers, unless required by applicable law.

  • Provision and Coordination of Care
    • As a wellness company, we use your personal and health information to help coordinate care with you and healthcare professionals, facilitate prescription and diagnostic test fulfillment, and support the delivery of diagnostic and wellness services, with some of these services provided by independent third-party providers. This may also include integration with electronic health record systems.
    • We use your information to personalize wellness services, product offerings, and educational content based on your individual health profile, preferences, and care needs.
  • Operations and Service Optimization
    • We may use your information to evaluate, develop, and enhance our services and technology infrastructure. This includes selecting and improving diagnostic tools and assays, refining digital user experiences, and supporting internal quality assurance activities.
    • We may use your information to: (i) support customer service, technical support, and answer user inquiries; (ii) provide you with notices about your account and/or subscription, including expiration and renewal notices; (iii) to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; (iv) to notify you about certain events or activities as part of the services such as webinars.
    • We may use your information—primarily Aggregated Data (defined below)—for the development, training, and validation of predictive models, health support tools, insights, and other algorithmic systems aimed at improving diagnostic accuracy, product quality, and personalization of services. This may involve using artificial intelligence (AI) and machine learning technology to help ensure we continue to provide you with quality operations and services.
  • Order Fulfillment and Logistics
    • We use your personal information, such as name, shipping address, and contact details, to process and fulfill your orders, including coordinating shipping, handling returns, and ensuring timely delivery. We do not share your health information for these purposes. Any third-party logistics providers we engage are contractually obligated to maintain strict data protection standards.
  • Security, Compliance, and Legal Obligations
    • Your information may be used or disclosed as required by applicable laws, regulations, or legal proceedings, including obligations related to public health, reporting, investigations, law enforcement requests, or other legal processes, fraud prevention, audits, and compliance with governmental or regulatory authorities.     • We use data to help detect and prevent fraud, security threats, unauthorized access, and misuse of our systems, as well as to ensure the ongoing confidentiality, integrity, and availability of our information systems and services

    • We may engage authorized third-party vendors or partners to provide services such as to secure data storage, software infrastructure, and system analytics or offer additional services such as telehealth or additional health diagnostics tools such as a body scan. These vendors are contractually required to maintain strict data protection and confidentiality, securing any data processed on our behalf, and are prohibited from accessing, using, or disclosing your information for any purpose outside the scope of their engagement.
    • Some of our authorized third party partners may provide services outside of the scope of the SiPhox offerings. With your permission, we may share your personal information with them, and if you use the third party partners’ services, you will be subject to the third party partners’ terms of service and privacy policy for those services.
  • Innovation
    • We may analyze, validate, and refine data, including Aggregated Data, to monitor trends, evaluate outcomes, strategic planning, refine medical algorithms, risk model, and conduct internal analytics and research aimed at improving health and operational outcomes and personalized care pathways.
    • We may use personal and health information to support the development of future health and wellness offerings, including new health services, diagnostics, or tools that support personalized health. We will notify users and, where required, obtain appropriate consent before using data for materially new purposes.
    • We do not sell your personal or health information. Any data use or sharing is done strictly to support your care, improve our services, fulfill legal obligations, or advance legitimate health-related purposes consistent with this Privacy Policy.

We may also use your information to contact you about our own goods and services that may be of interest to you. If you do not want us to use your information in this way, please adjust your user preferences in your account profile. We may anonymize and/or aggregate your personal information (“Aggregated Data”), and by doing so, the Aggregated Data does not identify any individual and is no longer considered personal information. We may use the Aggregated Data as follows:

  • Demographic (anonymous) data may be used for the following purposes:
    • Marketing
    • Product research/feedback
    • Product optimization purposes
  • Demographic (anonymous, aggregated, non-aggregated) data may be used for investor and market updates about my User Profile
  • Aggregate Data may be used for marketing insights and targeting
  • research and development
  • improving algorithms for health suggestions
  • internal statistics and analysis
  • use with artificial intelligence models and programs, such as ChatGPT, to provide insights for a consumer’s test results
  • create age/ inflammation/ health scoring systems
  • any other purposes described in this Privacy Policy.

Disclosure of Your Information

We may disclose the Aggregated Data about our users, and information that does not identify any individual, without restriction, including:

  • sharing de-identified data with vendors (ex: artificial intelligence company generating content)
  • informing new third-party customers about SiPhox’s average consumer profile
  • selling Aggregated Data for medical research/bio tech research purposes.

We may disclose personal information that we collect, or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, partners, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them, including independent, licensed healthcare professionals.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of SiPhox’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by SiPhox about our Website users is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

We Do Not Sell your personal information.

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent.   • Promotional Offers from the Company.     • You may have the right to withdraw your consent for certain processing activities with respect to your personal information, including your health information and/or the right to instruct us to limit the use and disclosure of your personal information, including your health information, to specific business purposes defined by law.
    • Our collection of certain forms of browser data via cookies may constitute personal information under state privacy laws. You can limit our collection, use, and disclosure of this information by rejecting the use of cookies in our cookie banner pop up.

Heart and Metabolic Customers

By signing up for SiPhox’s Heart and Metabolic Program, you agree to the Privacy Policy of Beluga Health P.A. of Florida, the third-party provider group whom SiPhox connects its Heart Health Blueprint members to, as well as the privacy policy of SiPhox Health.

Telehealth

As part of our services, you have the option to work with our partner, Beluga Health, and get access to telehealth care, including consultations with Providers and related pharmacy services. The telehealth services that Beluga Health provides may involve the electronic transmission of health information/health data, medical records that you provide, images of you, and other data between you and your Provider. SiPhox does not record or store the telehealth video sessions.

If you use Beluga Health’s telehealth services, (1) their Privacy Policy will apply, and (2) you consent to SiPhox sharing your health information with Beluga Health.

You may withdraw your consent to SiPhox sharing your health information with Beluga Health. Please review Beluga Health’s Privacy Policy to find out more about your rights to withdraw consent regarding their telehealth services. Please note that withdrawing consent may limit or prevent our ability to provide telehealth services and may require deletion of your telehealth-related health information.

California Residents

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. We do not share your Personal Information with third parties for their own direct marketing purposes.

Use of Artificial Intelligence (AI)

We may use artificial intelligence (AI) and machine learning technologies to support and enhance various aspects of our Services. This may include personalizing health recommendations, optimizing user experience, assisting in diagnostic or risk assessment tools, automating certain support functions, and improving internal operational efficiency.

Where AI is used in a way that influences medical or personal outcomes, such systems are designed to support—not replace—the judgment of qualified professionals. We continuously monitor and validate these technologies to ensure fairness, transparency, and reliability.

Personal information used for AI development and improvement is Aggregated Data whenever possible. If personal information is used, it is processed in accordance with applicable privacy laws and only for legitimate purposes as outlined in this Privacy Policy. We do not use your personal information for automated decision-making that produces legal or similarly significant effects without your explicit consent.

Complaints

Individuals may file a complaint with SiPhox and/or the State Attorney General for their state if they believe their privacy rights have been violated. Send an email to support@SiPhoxhealth.com with the heading “Privacy Complaint”. This email address is monitored by our support staff. An individual will not be retaliated against for filing a complaint.

Changes to Our Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We reserve the right to change this Policy at any time and we will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice and we will bring it to your attention by placing a notice on the website, by sending you an email, and/or by some other means. If you don't agree with the new Policy, you are free to reject them; but that means you will no longer be able to use the Services.
